I've had a seller try this on b4....they cannot get away with it,you have to go to your ebay dispute console and then report an item not received,it doesn't make any difference if they refund the money or not,you win an item then it is legally yours as soon a you have paid,that's why paypal should be used so you have proof of payment,trust me I'm a doctor !
