Bad Seller Behaviour

hi

i won a rare record on the bay for a very good price , but had a surprising message few days later ...

"I'm sorry to say whilst getting this 45 ready for posting it got broken so I am unable to sell it to you in this condition"

seller is handling rare records for years and i highly doubt about this version ...

asked for a scan or a camera pic but no response of course ... and my emails/pms are read but are unanswered ...

ever had a similar experience ? what should i do ? sitting on my disapointment ?

I think it's the alternative to using a reserve,

Would have thought hairline crack would have been a better excuse, had that one before.

What to do?

You have paid for the item, so you own it. Ask again to see a jpeg of the record, if no response state that you will have no other alternative than to leave negative feedback, you never know he may find another copy

I had a similar experience recently. I bought a record from the US which stated 'Free postage to the UK', when the auction was over, the seller wrote to me and said that it was a mistake in the listing and could I pay $6 for the postage? I wrote back and stated the the Free postage was one of the reasons that I bought the record and that they could have edited the postage cost if it was a mistake. I also threatened to report them to Ebay for misrepresentation. The seller apologised and sent the record free of charge.

If you have paid via Paypal, you are covered for up to £500 I think, so you need to file a 'Not recieved item' claim on Ebay, they will send Emails to the seller, they have I think it is 3 weeks to reply to Ebay or settle the claim and if you have no joy after that, you will be refunded via Paypal. Even if you did not pay by Paypal, you still need to file a claim on Ebay.

it sounds like you still hadn't paid for that. not that much you can do about it other than probably threatening him to shame him in public, happened the same to me but a with a much worse excuse ("my dog hit a box full of records which fell on the floor and yours got cracked")...

I left the record on the table and my 1 year old daughter picked it up and bit it.

Dealer told me once that the record had gone missing, probably stolen out of his box. I had my suspicions, but eBay sellers at that time could leave retaliatory feedback, so I just let it go.

Your seller deserves negative feedback even if telling the truth - has responsibility to look after the record properly after the auction ends. Seller can't leave negative feedback for you nowadays. I would only have let him off if he had given a funny excuse, like Pete S's!

YOU SAID HE HAS BEEN HANDLING RARE 45'S FOR YEARS, IF YOUR FEELNG LIKE YOU'VE BEEN HAD OVER BY HIM BECAUSE HE HAS DONE THIS IN THE PAST TO OTHER PEOPLE YOU SHOULD NAME HIM AND MAKE IT KNOWN THAT THIS IS NOT A ACCEPTABLE WAY TO SELL.

PERHAPS YOU SHOULD READ THE THREAD ON HERE ABOUT "BROKEN RECORDS" MAY BE THEN YOU WOULDN'T FEEL THE WAY YOU DO.

Take it on the chin IMO!! Why question the integrity of the seller by askin for scans etc?

If your not at a loss finacially! I would rather exert my energy positively in scouting for another,instead chasing damaged goods :thumbsup:
