won an item on ebay yesterday for £47. just had a message from seller saying that they forgot to put reserve of £85 on it so could not sell item to me. Apart from leaving neg feedback as they will then just leave for me is there anything I can do ?

I'm pretty sure that any sale is a contract and they are obliged to sell you the item, you need to report them mate. How would they feel if you won it for 85 and then you told them you only want to pay 45 for it?

realistically I suspect there is nothing you can do other than risk tit for tat neg feedback. I've come across this a few times unfortunately, and I'm sure others have also.

You could sue them using the small claims procedure in the county court if you have time on your hands etc. etc. :yes: I wish more people would do so, it would make a great news story and might give a few people a kick up the rear..... :(

Definitely report it to Ebay because the seller will probably claim that you and he have both mutuually agreed not to conclude the sale so that he canl get his sales fee back from Ebay. I doubt you'll get him to part with the record for the price you bid but at least he'll get stung for fees for a record he didn't sell.

He can claim all he likes, but unless you both mutually agree not to conclude the sale he won't get his sales fee back. Report him to Ebay and force the issue......pay for it... :unsure:

In my experience leaving someone negative feedback rarely results in the same in return. If he/she doesn't complete the sale, as they are obliged to do, under Ebay rules, then you are completely in the right to leave them that neg feedback. And they in return are not.

Leave the neg feedback on the 90th day after the auction, by the time he realises it'll be to late for him to do the same.
