Well thats it folks - I uploaded over 250 clips in the end, they have now banned me and taken down every single clip, so I hope you all enjoyed them over the last 6 months, it made a fantastic archive of 60's soul- all gone down the pan. Looks like I'll have to go back to doing dvd's, they didn't like me giving the stuff away :unsure:sad.gif

Another sign of this daft bloody society we live in today ! Something like that must come off but kids bullying & getting up to all sorts of bad & dangerous behavior is fair game ! Jeeez !!!

There's no appeal at all as far as I can see - my account has been permanently closed. Obviously I've still got the clips, but nobody else can see them now...unless they get them on dvd off me...which brings us back to square one really. I stuck all that lot up there for nowt as a comeback to everyone who slags me off for having the cheek to charge people for compilations.

You know what also, I'd had around 800 thank you's, got messages from artists and their families - can't even access the old messages to tell them their clips have gone.

Anyway onwards and upwards. I'll come up with sommat.

It's obviously some 20 something white boy in a suit who hasn't got a clue what Motown is who's taking down anything that looks "black and old"

Pete, can you not continue to post clips exclusively on the Soul Source web site ?

Or might that have obvious legal implications for Soul Source ?

Soul Source didn't host the clips mate, they were on youtube and then linked from there. The daft thing is, a lot of these only exist in collectors circles. I have some correspondence with a guy who was the main cameraman on the Night Train show and he told me the tv company had definitely wiped all episodes and was stunned when I told him I had three full shows.

I wonder if it is the old chestnut 'copyright' issues? I think cyber space is being policed a little more these days. The radio pirates in the 1960's helped establish a revenue stream for the record companies until the Marine Offences Act kicked in. Now we have the technology to do it on a grander scheme, and I might add not for hire or reward in many cases like the pirate radio stations, it seems the powers to be don't like the agro this creates. I think it is felt that the intellectual property rights are being abused. Everyone one of us has the right to create something and acquire coyright protection should we wish, especially if somebody else is making money out of it and indeed not crediting the writer or artist etc.

I think the internet is a great way to tease the audience into making a commitment about Cd/DVD purchases etc. I think it is sad Pete that this has happened. I guess there are more ways to skin a rabbit....

The plot thickens - the items complained about were definitely the 13 segments of Motown 40. But it wasn't Universal/Motown who put the complaint in, it was these people:

I'm not an expert on any of this stuff - either IT wise, copyright wise etc - I no nothing. What I do know is that the clips you posted up Pete are precious treasures - some of the stuff was stunning to say the least. We're else would we have been able to view such stuff - it would have been lost in the archives for ever. The company who appear to have complained and bought it all to an end are ridiculous - what are they doing to share such treasures with us - and to bring the unsung talent to the attention of more people. Doh!

They wouldn't know what hit them - or why. Who cares about Motown 40 anyway, but all that other stuff - and it was so nice when some of these artists contacted me themselves, or their relations did, they thought nobody remembered them and there was no footage - and suddenly they were known all over the world. Not now though. So it's that which upsets me, I mean I had relations of Tony Clarke, mamie Galore, all sorts of people write to me. I sent a dvd to Etta-blooming-James herself!

Hi there,

Thanks for your email.

Federal law requires that we terminate accounts when they are found to

repeatedly infringe copyright. Because you have had other videos rejected

in the past, we are unable to reinstate your account. We are not the ones

who say what is copyrighted and what isn't. The owners of the copyrights

come to us and ask us to take them down. If you get permission from the

copyright owner then you may be able to post video's again.

In order to take action on your request, we will need to receive a written

communication that includes substantially the following (please consult

your legal counsel or see Section 512©(3) of the Copyright Act to

confirm these requirements):

(i) A physical or electronic signature of a person authorized to act on

behalf of the owner of an exclusive right that is allegedly infringed.

(ii) Identification of the copyrighted work claimed to have been

infringed, or, if multiple copyrighted works at a single online site are

covered by a single notification, a representative list of such works at

that site.

(iii) Identification of the material that is claimed to be infringing or

to be the subject of infringing activity and that is to be removed or

access to which is to be disabled, and information reasonably sufficient

to permit the service provider to locate the material. (In order to

ensure the fastest response, please include SPECIFIC URL LINKS if possible

- Linking to search results may be insufficient for us to identify your

video, as they are subject to change.)

(iv) Information reasonably sufficient to permit the service provider to

contact the complaining party, such as an address, telephone number, and,

if available, an electronic mail address at which the complaining party

may be contacted.

(v) A statement that the complaining party has a good faith belief that

use of the material in the manner complained of is not authorized by the

copyright owner, its agent, or the law.

(vi) A statement that the information in the notification is accurate, and

under penalty of perjury, that the complaining party is authorized to act

on behalf of the owner of an exclusive right that is allegedly infringed.

Please just respond to this email with this information and we will be

able to move forward.

Please also note that under Section 512(f) any person who knowingly

materially misrepresents that material or activity is infringing may be

subject to liability.

Please make sure you have fully completed all the requirements before

submitting for approval.

Hope this helps,

Hi Pete

I hope that DVD's of this material, are available through a different source.

I would certainly be Interested in compilations of these clips, as I'm sure that many others would too.

When you see some of the nonsense that is posted on such sites,

It is a crying shame that these quality clips were removed. :wicked:

Like I said Pete, you can host them on your own webspace :wicked: Did you save the original clips you made?

I'm new to this forum and didn't put two and two together to realise it was Pete who was responsible for putting all that great innercalm stuff on youtube. I'd been enjoying the clips for a while and can't see how them being posted up there infringes copywrite any more than stuff like the Legends of Rare Soul DVDs; which surely can't be legit. I guess youtube was certain to go the way of Napster once it got all corporate.

I think Pete should be proud to have done what he did and though there's a noticable collective arching of eyebrows hereabouts at anyone trying to make an honest crust - e.g. the Casino Cafe, I'd be completely cool about him making a few bob flogging the same stuff on DVD .

I'd also be thinking about having "I sent a DVD to Etta Bloomin' James" as my epitaph.

Posted

Like I said Pete, you can host them on your own webspace  Did you save the original clips you made?

Yeah I've got everything - but only in it's original format i.e. on either dvd or vhs. So first I have to get it from the dvd to the pc using an editing program, then you have to turn the clip into an mp4, and then upload it, and the wholeprocess takes - on average - about 25 minutes per clip. So multiply that by 250 and you can see why I'd be reticent to start all over again. Also, you know you say I could host them, but what would we use to play them without youtube's player?

It's a lot easier for me to sell a full set of the beat or a compilation of shindig clips or ed sullivan clips on dvd!

Posted

Well, you simply rip to wmv and use a wee bit of html to display it on your website  Up to you of course smile.gif If you do a trial one and upload it I'll sort the code so you can see what I've done for you  Windows Movie Maker application will make the clips internet ready

It don't matter which way you look at this, putting up the clips and any others infringes copyright law, whether anyone likes it or not. I would think it applies to 75% of what goes up on 'youtube'. It was only a matter of time before they cracked down on it in the same way as they cracked down on the filesharing sites.

If my memory serves me right, 'Youtube' was originally just people putting up stupid home videos and stuff. It was only later that people started putting up film and TV clips. And again, like it or not someone else OWNS these clips and they have a right to be paid and control the usage.

Put it like this - you've built a house from scratch. Would you let everybody come and use it for it intended purporse when they liked without paying for it at all ?

Yes I had noticed they had been removed (all the plug-ins on our scooter club website stopped working  ) Yes I did enjoy them and they will be missed by everyone! Onto plan B?

Legality?.... would thousands of people ever have seen these classic Soul clips otherwise? I think YouTube have a major problem, what about all the "pop" videos posted up on there?

Are they going to ban everyone who has posted anything other than a "home video" up on that site? Can't wait to see the content of that site when they have removed "anything that belongs to someone else" .................they will have to change their name to "Shittube.com" maybe "pootube.com"

looks like "Jeffery" might be looking for a new job soon :P ............Up yours Jeff !!! (shot themselves right right up the tube if you ask me) RIP Youtube

That is sad they all gone and if i had known it would happen i could have told you a way how you can save them to your computer my friend told me about it and i could end up saving video's i like.

But there is a plan for You Tube soon which could be for the good but might not be much use to us Northern soul fans only part might help and that is they are hoping to do a deal with the major record labels to let them post up every promo video made by all the artists on there labels meaning we could be able to watch say all promo video's by say Janet Jackson, Rod Stewart, Kool and the Gang, Spice Girls etc etc even lesser known acts like Mental As Anything and so on it can only be good but if Northern soul wasn't a big part of the promo video no good is it.

It's dead easy to save them - theres a youtube downloader, then you just convert them. Obviously this isn't a problem forme as I've got the originals anyway. Just guts me a bit to think after loads of these\artists finally got to see themselves after decades, they probably tell their friends and families that they are up on youtube - and now they aren;t. Last week I sent 2 dvd's to Charles Hodges family, showing him on The Beat in 1965, he wasn't aware of their existence.

Anyway, looks like it's all ater under the bridge now, it's done and there's nothing we can do about it.

Anyone wanting the clips of course can get them directlyfrom me

Are paypal allowed to give these people my name and full address - because thet did.

If its a case such as the above yes they are well within their rights (im 100% certain any way, some please correct me if im wrong) to hand out your address to a third party when its a legal issue.

Wish they would be as hard on the ebay bootleggers  its not as if you were making any money out of it what so ever!

I guess the police can make paypal surrender your personal details because a crime had been comitted... however, I don't think they can make you return the tape as it's legally yours.. unless they use the power of confiscation as a punishment???

Like everyone else who's posted I'm really gutted for you.

I think the comment made earlier about it being ok to post clips on Youtube of kids bullying etc is really valid and shows how totally upside down things can be at times.

Don't know if you would want to go down this route or whether there might be some legal come back if you did but this would make a great story for either TV and/or the newspapers, local or otherwise.

Such a story would identify the double standards involved and tell the story of what you have done, including the stuff re your presents to artists and their families, to a wider audience and put some of those artists names back where they belong, in the headlines!!!

I hope you find a way round this.
