Julianb Posted March 9, 2007 Posted March 9, 2007 Won a 45 on 17th Feb. UK seller based in Darlington sold in $ with no postage costs. Asked for a total price on the day and have followed up with a separate email requesting full cost. Not had a reply. Now, I realise the seller may be on holiday, but I would have thought it would have mentioned it in the sales blurb. Not a high price item, but my bid was a reasonable price. Can the seller refuse to sell ( surely he should have placed a minimum bid, if he required a minimum amount?) Any thoughts of how I can get this sorted. Thanks Julian

Thanks Julian I'd hit the "Request total From Seller" icon on your ebay page to see if he/she replies. If not, use Ebay's dispute procedure. If the seller is on holiday it's a sodding long holiday !! Good luck. Rich

Happens all the time. Poeple don't put reserves on then sulk when they don't get what they want. A bloke on here last year actually threatened to remove his records in a huff if nobody bid - there was still 24 hours to go. You can't force him to sell but you can leave bad feedback if he doesn't and if he reciprocates have eBay remove yours.
Supercorsa Posted March 9, 2007 Posted March 9, 2007 Why do some listings state something along the lines of "If no payment received a Non -Paying bidder thing will be lodged with Ebay". Is there a Non Selling Ebayer thing you could lodge with Ebay?

Thanks Julian Julian, As a very experienced ebay user, let me first say this. Ebay auctions are legally binding contracts as you will see in the regs. Consider this, the seller may have a genuine reason for not replying, examples : sudden illness (I had this with a guy who had a heart attack during the listing period), personal problems, bereavement, Internet connection problems, or a computer virus. You must contact him on EBAY GENERATED messages as they are non-deletable unlike standard server emails. At the same time file an "ebay item not received notice". Most importantly, if you think he might not supply then you must pay him with paypal because then there is no way he can get out of posting it but it would have to be recorded or registered. If he fails to get proof of such then you file a paypal claim for a refund, believe me the shit that causes a seller is intollerable. Whatever the case, you can take action. Remember it is legally binding so if you think you have a case you can also take a civil action in which case he would also have to pay costs. You must first follow all the correct ebay procedures, even recommend they close his account if he fails to respond. You have the upper hand and if it appears that he does not want to sell the item then come down hard on him. Anything else you want to know just email me thro here. Julianb Posted March 10, 2007 Author Posted March 10, 2007 Thanks for all the replies. I did request a final payment figure via ebay and have subsequently emailed him via ebay to request total again. I have now just mailed via ebay again to tell him I am giving him a couple more days before I file an ebay complaint. I will keep you posted. Julian

Martin is right, and the seller may have some problems. You should check if he's still active on ebay, ask about him to the other guys who bought from him, etc...
Julianb Posted March 13, 2007 Author Posted March 13, 2007 Now sorted out with seller ( he's had family problems). Thanks for all your help. Cheers Julian
