Guest ShaneH Posted August 1, 2006 Posted August 1, 2006 is this claim the 1st of its kind on the soul scene? has anyone been succesful before? we may soon see those signs they have in supermarkets - the ones that indicate a slippery floor due to cleaning we could see the floodgates open if this case is successful. could change the 'dancing' part of the scene for good Shane
Guest Posted August 1, 2006 Posted August 1, 2006 Shane, I'm sure this is most definately a one off and one I find annoying - as I've already made quite clear. Where would it end? Everyone I know just get on with a soul venue and let's face it, most of them are pretty dire by the end of the night floor wise irrespective of talc and as said previously, the loo's are terrible for flooding at major venues but no-one complains as it's not important. You just know to be careful or be laughed at when you do take a tumble.
mischief Posted August 1, 2006 Posted August 1, 2006 (edited) Mark said it was he's 40th.. so maybe there was none soulies there.. was it one of them that fell? Maybe she had bad advice and thought she could sue the club not Mark... Them injury lawyers for you are bad news.. you sign a contract with them they promise you the world but if you pull out you have to pay there fees for work they carried out... Not a lot of work but high fees.. To be honest if I slipped in an overflowing toilet at a do and broke my arm i'd sue the venue... its the same as at work if it rains we have to put them yellow slippery signs out in reception saying wet floor.. It is our responsability.... its all health and safety... I would not sue a promoter for talc on the floor though.. Edited August 1, 2006 by mischief
Guest soul kitten Posted August 1, 2006 Posted August 1, 2006 What ever happened to consideration to others, I used put a small amount on edge of dance floor...... Karen Have got to agree with Karen, talc can be a real pain, i know when we were running melodies in York last year had a stand up row with owner over people using talc, put notices up but everyone ignored them even offered to clean floor myself!! am sure if anything had happened he d have been on my case i did nt know about any insurance ,never crossed my mind. seems sad that everybody out to sue nowadays especially as its a friend. hope it turns out ok for you mate can really make you give up running soul nights when you hear of things like this.
Guest Posted August 1, 2006 Posted August 1, 2006 To be honest if I slipped in an overflowing toilet at a do and broke my arm i'd sue the venue... ... I would not sue a promoter for talc on the floor though.. That's rather a contradiction dear Sir
Mandy Posted August 1, 2006 Posted August 1, 2006 A girl I know tripped down a step at a Stafford Revival night a couple of years ago and went down the road of suing them due to personal injury. The club (what was the Top of The World) tried to bring the room hirer into it but failed miserably as a club it was up to them to keep an eye on health & safety issues not the people of hired the room. Don't know if this helps.
mischief Posted August 1, 2006 Posted August 1, 2006 That's rather a contradiction dear Sir Probably... but 100% of venues are hired out as a commercial venture its how the owner makes a living ...fire regulations health and safety etc all have to be taken into account..... what % of northern promoters make aliving from putting on do's, most are lucky if they clear the dj's fees .... venue hire ...printing of flyers.... deck hire.. etc.. so they may make a couple of quid big deal.... Good luck to them.. If you was in Tescos and slipped on a bottle of spilt talc and was unable to work due to a brokem limb and you was being paid SSP and because of that got behind on your loan payments on your car your mortgage etc, what would you do?

Shopping is a far cry from a dark, stumbling, night in a cellar with your head full of soul and your lungs full of talc pissed out of your head Oh, is that just me that ends up like that?
Guest ruffsounds Posted August 1, 2006 Posted August 1, 2006 hi Mark Having read this thread i thought this is one for the wife who works for a firm who specialise in all forms of accident claims from all areas even Criminal ones and Workplace related accidents or Medical Negligence and she assures me that it is the Club's responsibilty and that they should shoulder the burden because if they are operating without a Public Liability licence the doors of the Club should not be open to the Public as it should have said licence under the Licencing Law of selling Alchohol and they are the ones who the responsabilty lies with. So i think you will be ok Mark. cheers Ruffsounds
grant Posted August 1, 2006 Posted August 1, 2006 ============== thanks mischief and everyone for the support... going out in a mo to down a few pints to stop thinking about it .. cheers guys fluff Chin up matey...hopefully it will sort itself out. Some good advice on here from posters Mark.
Mandy Posted August 1, 2006 Posted August 1, 2006 You enjoy your pints, I think from reading the above posts that you are in no way liable for what has happened.
Cheltsoulnights Posted August 2, 2006 Posted August 2, 2006 an overflowing toilet that the management have no knowledge of is not necessarily grounds for a claim unless it happens regularly. The talc would have been known about, As i presume they have had doos there before. Also no one seems to have mentioned that whoever put down the talc is liable as well
grant Posted August 2, 2006 Posted August 2, 2006 Hi Mark Not sure if this will help but gives a good example of a terms and conditions for hiring out the premises at a leisure centre in Harlow - liability and health and safety are mentioned here. Obvioulsly the club you hired did not show you or ask you to sign for anything like this. I have run soul nites here in stockport on numerous ocassions and never even given this a thought.... Occupiers Liability Act springs to mind having studied civil law as a module in my degree a few years back. Isnt the first appontent ususually free at a solicitors if you want some real legal advice/feel the water .....without being ripped off Grantharlow.doc
Guest Stuart T Posted August 2, 2006 Posted August 2, 2006 and your lungs full of talc pissed out of your head I dread to think how much what you're dancing on might cost.
Guest Posted August 2, 2006 Posted August 2, 2006 I dread to think how much what you're dancing on might cost. About 47pence at a guess I'm one who puffs at the side of the dancefloor, does a small skate in it and then enter the main dance arena
sister dawn Posted August 2, 2006 Posted August 2, 2006 About 47pence at a guess I'm one who puffs at the side of the dancefloor, does a small skate in it and then enter the main dance arena Me too Karen Johnsons though, is a better grade of talc and 99p up/down this way
Guest Posted August 2, 2006 Posted August 2, 2006 Same here, Johnsons, but a small bottle (mini one) will last me around 6 months So with that math in mind, one airing is likely to be around 15pence then

Glyn Williams Posted August 2, 2006 Posted August 2, 2006 yes, my opinion for what it's worth is that this person is no friend of yours. at worst you get sued, at best venue stops you having any more soul events. No friend if you ask me, just a greedy bleeder looking for a free ride.

Guest Little Miss Soul Posted August 3, 2006 Posted August 3, 2006 hi guys ,,in a bit of a perilous situation here..sorry if posting in wrong room. . i did a northern nite last year for my 40th..and hired a local club for the doo.. about 15 mins from the end..a friend of ours slipped on some talc and consequently broke her elbow..causing her to be off for some time.. the person decided to sue the club,,who have in turned passed this on to me being the hirer of the room. what i need to know is if anyone can help is the following:- ive been asked who my insurer is and obviously at the time its not something i thought of. Does this make things worse for me ? is it worth asking the injured party to cancel the claim? (its one of those no win no fee things) what likely charges are they likely to charge for doing so? im hoping our friend will be able to drop their claim but i have to admit that im shitting it a little..the price of entertaining eh? naturally this is a warning to all of you out there who put an event on and the consequent of an unfortunate accident.... thanks for any advice guys,,regards mark This sounds like a nightmare Mark. Sorry I can't give you any advice but I wish you lots of luck trying to sort this out. You would think the person involved would take personal responsibility for this wouldn't you?! Even if she's not involved in the scene, she could obviously see the talc on the floor! These people really annoy me. I hope it gets sorted anyway x
