Guest MissHongkongfuey Posted June 5, 2013 Posted June 5, 2013 Good Morning All, I'm after a bit of advice please. Here's the rundown..... 11th May....sold a record to France and sent International signed for. 15th May, French postal services attempted to deliver unsuccessfully. Website states to re-arrange collection or collect from post office otherwise the record may be sent back to the UK. 16th May, I contacted the buyer asking him to collect or re-arrange and that if he doesn't. it may be sent back. No reply from buyer!! 22nd May....second attempt to deliver by French postal service. Unsuccessful again, so I contact the buyer once more. Still no reply!! So I asked Ebay to contact him. They sent him a message explaining that it will end up coming back to these shores if he doesn't collect. Their message was in French, so he had no excuse in claiming that he didn't understand. 31st May.... 3rd and final attempt to deliver this item unsuccessfully again! Yesterday morning I wake to find a message from him saying that it's been sent back to the UK and can I re-send as he needs it for a gig this Saturday!!! His English was word perfect btw. Now here's my dilemma.....Firstly, I have no idea where it is now and I'm not sure if there is a returns address on there, although I still have my postage receipt. (I think its in a re-used mailer that should have my name on, if the packet was to be opened) Am I obliged to re-send it?? And if so, do I have the right to charge him again for postage. I really don't know how he has the nerve after so many messages and i'm really not sure that my record will even get back to me. Stressed to say the least. Will appreciate any advice here. Teresa
Dave Rimmer Posted June 5, 2013 Posted June 5, 2013 1. You can't send it again because it hasn't come back to you yet. 2. It should have your name and address as sender on the package because this is usually a requirement when you post it. 3. If you do send it back to him, of course he has to pay postage again. It's not your fault he didn't collect it when he should have done. 4. Stop stressing. You sold the record, you have your money for it. You posted it, it arrived. Any problems after it arrived at his door are his problem, not yours. If it doesn't come back to you, I would suggest that you tell him he has to make a claim against the French post office for losing it. 2
Guest MissHongkongfuey Posted June 5, 2013 Posted June 5, 2013 Cheers Dave, Never been in this kind of situation before as I rarely sell anything. Just worried in case Ebay want me to refund him and of course wanting to avoid negative feedback too. Also, if anyone has had a record returned to them....how long does that process usually take?
Jnixon Posted June 5, 2013 Posted June 5, 2013 (edited) 'If it doesn't come back to you, I would suggest that you tell him he has to make a claim against the French post office for losing it' He could and probably will make a paypal claim, which he most likely will win. If it doesn't get returned to you (as you are not sure if you put a mailers address on it), you could lose both record and money. It's a toss of a coin if someone opens it up to check if there is an address inside when it gets back to the UK. If it gets sent back to the UK with no address on it the UK postal guys will send it to the black hole warehouse in Northern Ireland and sadly you nor him will ever see it again. if it does come back id ask him for more postal money, as its not your fault he didnt pick it up. Guest MissHongkongfuey Posted June 5, 2013 Posted June 5, 2013 Yep, that's my worry. He'll put in a claim and I not only lose the record, have to refund both postage and cost of record too only then to have the cheeky Bas*ard leave me negative feedback. No more sales, international or otherwise in future. I'll just sell on here or the Hassle free. I've just left him a message saying.... either reply to my messages, provide proof that it's been sent back or put in a claim with the French postal services and claim it back yourself!! I really can't be arsed with lazy ignorant timewasters.

As you have already involved ebay in this I don't think a paypal claim against you will be successful (ebay own paypal). I would get in touch and let them know what has happened just to make sure. HTH Paul

It's unlikely a paypal claim would succeed againsy you becaiuse you have already made Ebay aware there is a problem with him as a customer. Bearing in mind that he also ignoredthe message Ebay sent him they are hardly likely to look favourably on a claim from him. What would he be able to say ?
Mr Smithy Posted June 5, 2013 Posted June 5, 2013 You've already gone above and beyond. You should be good, even EBay will probably accept 3 attempts at delivery and no replies till it's too late. But as always they make if more grief than it's worth in the end. I really don't know how he has the nerve after so many messages Easy, he's French.
Guest MissHongkongfuey Posted June 5, 2013 Posted June 5, 2013 That's what I was hoping for to be honest. If it did arrive back to me, I'd have no problem in sending it back as long as he covered the costs up front. It's just that he ignored all messages, now claims that his English is poor (But it wasn't poor when he asked me to send again because of a gig this Saturday)!!! The message sent by Ebay was also in French and I presume the Postal service notification was also in French. I've never had anything returned before so, have no idea how the process works.... Gonna see if I can get some help over the phone from them I think. Just to cover myself if I can.
Mr Smithy Posted June 5, 2013 Posted June 5, 2013 I don't think there is anything to cover. You did your bit, the PO did theirs, even EB did - he didn't. He won't get it by Saturday unless he gets off his a** and goes to the PO and looks for it, if he won't do that ........... I'd relax and stop worrying, there is a never ending stream of them you can't do anything about and it's bad for your nerves. It's out of your hands for now.
Northern Soul Uk Posted June 5, 2013 Posted June 5, 2013 I would ring eBay and explain the situation, this may help them to understand the case if he decides to open one against you. If the record turns up at yours, I would tell him that you want payment for postage again as it was his fault he wasn't there to take delivery and didn't collect it. In many cases the buyer will agree if he really wants the record. If not and he opens a case, you will hopefully have told eBay the details and they keep a log of your calls and enquiries.
