"misspentyuf" Ebay Seller Issues?

Hello Gents , I bought some records on an Ebay auction about 12 months ago from e-bay seller "Misspentyuf".

Recently I was contacted through Ebay by a person named "Chris" (from the Rochdale area) who has claimed the records from were stolen from him. Chris explained his stolen records were purchased by "Misspentyuf" from the thief and did not ask to many questions.

I have been asked by Chris to check and return them , however I wondered if anyone else has heard about this or had similar experience ?

Graham , you've obviously done nothing wrong and bought them in good faith , so I would have

thought they are legally yours (unless the Police are involved and they can prove they were stolen)

then you may have to return them and take a loss. Can the lad prove that they were his or it could even be

a scam. Would you be prepared to sell them back at the price you paid ?

Not much help I know but I'm sure you will get some creative response on here mate soon.

How the hell can he possibly prove it? Sorry but I think he's pulling a fast one. Tell him to supply proof that the records were his.

don't want to sound unsympathetic to "Chris" but it's not up to you to return them as you have purchased them "legally" via ebay and 12 months ago at that.

Chris needs to report the matter to ebay and or the police,ffs you could have sold them long since.

If his collection are like most of ours some of the records will have very distinguished features for example, faded and torn labels, writing on labels, maybe the odd click on a 45.

Ask him to email a list of his missing 45s maybe i.e. let him volunteer a list and ask him to point out loads of "features" - they may help ascertain if he is being truthful..............

Also did he report the crime back then, if so he will have had an incident number and further did he claim on his insurance (if he had any).....

if you've already said you have the records still & he has filed a police report & obviously has proof you got the records from the stolen lineage, then the cops will take them & return them to the original owner.

there is no way he can know you bought them without either being the original seller himself (under an alias) or having legally pressured the thief for details of who they onsold them to & then down the line who they sold them to. ebay hides your user name from view when you win stuff usually. he could have gotten it by trolling through your ebay feedback though i suppose.

it's a weird one for sure. i'd be interested in how it pans out.

just looked them up on ebay, this "Chris" character is possibly legit since there's nothing particularly valuable or rare listed, just a bunch of common UK & US press soul 45s by the looks. prob first 3 pages here

An unsollicted message sent through ebay, sorry but that is not the right way to go about things, if the police are involved, they would contact you, the senerio you have presented indicates the "fence" suffering no financial loss if you were to return the records. Only you, as already stated, the victim may have been compensated through insurance.

If you have brought stolen records, let the police advise you as to wether you have to return them, not an email from somebody you have never met.

Thanks very much everybody for taking time to post reply. My initial thoughts were that Chris was genuine , even giving me his phone no and address. Then when I had more time to reflect I was bit suspicious. Chris said the records were worth about £6000 and that the Police told him that when they questioned Misspentyuf, he said he had had paid £600 for them. The Police said weighing up situation they would not be taking any further action.

My instinct tells me that that does not sound quite right ...especially with quality of some of the LP's he mentioned..

So where does that leave matter ? I have no evidence from Chris that Police or Insurance company were involved.

That said , I did not pay much for them on the auction - about £10.00 all in - and do not like thought of having stolen property, especially records as know what it is like to have some stolen !

I will ask Chris to provide evidence of Police involvement or suggest he contact Ebay about this as this must be fairly common matter..

List of stuff stolen..he rarest 45's were Cool Off 1st label and Otis Clay You Hurt Me For The Last Time (Dakar).

There's prob about 50/70 LP's still missing, including Linda Jones Hypnotised,Linda Jones Your Precious Love, Artistics Im Gonna Miss You, The Articulate Artistics, Garland Green Jealous Kinda Fella, Ambassadors Soul Summit, Bobby Patterson on Paula, Impressions Young Mods Forgotten Story Edwin Starr Soulmaster Ebonys Phil Int Fantastic Four Incredibles Audio Arts, Sam Dees Show Must Go On, Bobby Wilson I'll BE Your Rainbow, Darrell Banks Here To Stay, Barbara Mason Oh How It Hurts.Etc etc. All were on original USA labels apart from B Mason which was on UK Action (white demo). There were also several 12" including Barrett Strong Man Up In The Sky James Epps High On The Hill Johnny Dean Sittin Around My Table Ty Karim (cant remember title, red and blue label.)

The thief turned out to be my ex gf's son, who sold them to a local record shop.He was arrested and charged. The police found about a quarter of the missing records in a flat above the shop but did not charge the shopowner as he maintained he bought them in good faith and didnt know they were stolen. I have found out that "misspentyuf" now has a different seller name on e bay and there are several records which i owned currently being offered for sale by him on e bay. I have also found out some more information about this seller that the police were not aware of. As a result of this, i am taking civil court action against this seller. If anyone has any more details regarding the records that are still missing, or wants any more info, pm me and the info will be treated strictly confidential.

There was a police incident number (crime number) but as i said the police were a complete waste of time, their attitude was I should be grateful i got some back. As i said, I am taking him to a civil court.

Sounds like a complete nightmare, something we all live in fear of.

Yeh i dont blame anyone apart from the lowlife thief and the shop who bought them off him, who should have at least suspected something when the thief accepted such a small amount of money. I would think that a documented ebay sale would be producing (rather than getting rid of) evidence that someone was still selling stolen records after knowing they are stolen.

if he had previously documented the contents of his collection (e.g. for insurance purposes) and the records purchased on ebay closely matched the contents, that is a way of providing evidence at least that they were his records. however, i wouldn't just give them to him on his word, I would wait until I was legally ordered to do so. Also, it does seem suspicious that he would find the buyer of his records a year after the auction happened. How did he find out the information that the original poster won those records?

I think it's probably good advice if you only have a box or two of 45s to make a video of yourself flipping through your records, like the ones pete posted a few times.

The Ebay seller told him when he fronted him would be my guess. How else would he have known that the OP even had those records?

Flip neck. If some criminal mastermind Northern Soul thief was looking for a score, I think spamming people at random in the hope that they may have just purchased exactly what he was looking for would be the worst plan he could possibly come up with.
