I sold a record on ebay and the guy wasn't happy becasue there was writing on the label and I hadn't mentioned it. He opened a dispute on paypal and I refunded him the money. Up until this point we were in regular contact and he seemed a genuine guy.

Anyway, the record hasn't arrived and I've heard nothing from him. This was a few weeks ago and I know I've been ripped off but is there anything I can do?

As a seller on Ebay you have no redress at all with the simple fact that you can not now post anything other than good feedback on a buyer or nothing, you have done all you can to correct the mistake and it does sound that you have been dealing with one of the many people who try it on all the time on Ebay, all you can do in the future is describe the item in complete detail and post pictures of both sides of the record to display any WOL etc. also you should have requested the return of the record before giving a refund, seems to be anything goes wrong on Ebay they do little or nothing to offer any support to sellers if things go tits up, when selling records I guess you have to work along the lines that the customer is always right and always offer a returns/refund service but looks like you have been taken for a mug here as the guy has had his cake and seems to have swallowed it at your expence, good luck and I hope you can turn this around but with Ebay don't hold your breath.

if you sent him the record you will have his address if you have a lot tied up in it give him a knock unless he lives miles away and not worth it good luck yocky

I would not have refunded him until you had the record back - If you had said this in your communications with him Im not sure if Paypal would do a reversal!

The postal system is shot to ratshit at the minute due to the bad weather before xmas and the normal xmas disruption.

There's every chance that it's stuck in a backlog - I'm waiting on a few things, including my driving license, and it's purely down to this.

I wouldn't write off this person just yet.

i sold a jimmy fraser demo to a guy in the states for 260 and he claims he never received it . had to refund him and still chasing the post office for this. seems like the seller has less rights than the buyersad.gif

Call Paypal, tell them you want to appeal the dispute - the buyer should have sent you the record back via a tracked service (to prove it was delivered). If you've refunded him, and the record hasn't been marked as delivered to you, open an appeal.

I have often wondered if the content posted although being marked positive read negative such as .... non payer . picky buyer. slow to pay. untrustworthy . would be printed by e bay?

I think if the buyer complains Ebay will remove the feedback as a false positive.

i have to say this 16 replies now and nobody else has.... maybee if you had 'mentioned' the writing on the label you wouldnt be in this situation today. theres nothing worse than pulling a record out of a mailer and it has bob loves julie all over it, i had one last week, it really should be 'mentioned'......

Hi.

If you checkout paypal rules he has to prove you have recieved the goods back to get a refund. Sorry but a mistake.

Good news. As you hopefully can prove he received the goods you can open up a county court claim for unpaid goods.

Its a good idea to contact the guy and warn him of this in advance as it may get results

thats all bollocks my dear friend, i bought a car over 9 year ago someone in Lincoln, to find out it was full of sawdust in the engine heap of shit, payed good money for it replied to him no answer, on the way back from cleethorpes weekender sunday night i gave him a look noone was in i wanted to cut down his trees there were to close to the front road i coined his sealed units and i dont feel guilty they were my bad days.

I did a whole house out for a chap a good few years back who was setting up home with his girlfriend. He paid me some money up front so all seemed kosha.

Anyway when I finished the job he came round, said thankyou very much and I never heard from him again. Until I took his front door off and hid it in a friends ( nearby) garden. Police called me and I explained I wanted my £5000 or so before he got it back. Mr policeman said I had to put his door back on because even though he owed me money, and was happy with the work I had left his home open to undesirables and if anything happened I was liable.

I put the door back, begrudgingly and waited for the money. When after a good few weeks of NO contact etc... and no settlement I still had a key to his house so I changed the locks to all his doors and superglued ALL his windows shut. Never did get paid but it felt good.

Anyway besides the point I suppose. If you still have the address as to where you posted said item I would take the day off if I was you and pay them a visit.

nice one kev and i don't blame ya, he never got back to me, he must've known it was me, i wanted to confront him young bloke a good 6ft he was big looks like he was carrying a pair of tits, i was so angry definitely an elbow across the bridge of the nose if i would've got him on the public road not on his property billy
