At Prestatyn, I had trading standards say I couldn't sell Demo/Promotional copies which had not for sale on the label, thought the guy was joking at first, until he showed me his ID and then I realised he had security and the Pontin's Manager with him. Anybody else had a run in with these guys elsewhere?

Now that is interesting.

Have you actually followed it up to see whether he was correct. What about the other sellers at the venue.

dealt with TSOs in the food industry over the years and usually they are quite reasonable/sensible people. From my legislative knowledge i feel that you may have had an arguement that could be the loophole in any legislation around sale of goods act etc in that it is not being offered as a retail sale, eg by a registered company , but as a private sale, as you the seller. and it is at the discretion of a buyer to purchase that 'record' from you at an agreed price between the two parties.

personally i think that as an under-manned and 'over-stretched' organisation with local government that they woiuld have better things to do (unless of course their main mission and reason for being there is to catch any bootleggers at work selling copies en masse?)

To me the issue is not about the legislation or lack of it it is about enforcement and how that is structured and regulated -Universal losing a case well that in itself is very interesting bearing in mind their financial clout so you can bet your doller that a strong appeal may ensue but so what -its finger in the air imho "has the sex or race discrimination act stopped racism or sexism ? So the old law lords wait for the test case "which costs a bomb -with no recommendation that institutionally biased Judges make the right decison "there usually do screw up at some point lol,and then what back to the issue of enforcement !!!

Dont understand the point re the sale of goods act also it was brought in to protect the customer first and foremost and I do beleive that the first copyright rule although frought with issues is a pretty solid principle,the article has got me thinking however about the wider issue of piracy and how does promotional give aways to radio stations etc fit in with the potential action? Also is it not common practice that the record industry have used since time and memorium and suddenly there are pissed because somone is selling promos [bOLLOCKS ]this is about corporate power and loss of potential market share -mainly necesitated by the fact that the music industry conclomarates cannot regulate downloads and are thus needing a bit success DO NOT RELY ON LAW LORDS FOR COMMON SENSE THEIR ARE TO BUSY GETING MARSH MALLOWS THROWN AT THEM BE MISS WHIP LASH AND PLANNING THEIR NEXT TRIP TO VISIT MADAME SIN!!!

Ebay were also involved on a test court case last year after they prevented people from selling promos. Ebay lost the case and now allows promo copies of records and CDs to be sold. So I don't think the STO was correct to prevent you from selling these items

Absolutely also theire is a wider issue ie restrain of trade,after the first copyright law!!! Could do with some expertise here ADY TONY PAUL M to get an inside view!!!
